 Classified CirclesTM PROVIDES THIS SITE AND RELATED SERVICES SUBJECT TO THE USER’S COMPLIANCE WITH THE TERMS AND CONDITIONS SET FORTH BELOW. PLEASE READ THE FOLLOWING INFORMATION CAREFULLY:
 
Classified CirclesTM  and all volunteers who help with this effort assume no responsibility for items or transactions which are advertised in this fundraiser. Sales transactions are solely between buyer and seller and on their own premises. Asking prices/donated percentages are not necessarily fixed. Negotiations are independent.

Classified CirclesTM operates independently. Its function is to provide a forum to buy sell and rent for our community. Donations are at the discretion of the seller.

  1. General Release

    NEITHER     Classified CirclesTM, THE CHARITY NOR THE VOLUNTEERS HAS INVOLVEMENT IN THE ACTUAL TRANSACTION BETWEEN THE BUYER AND THE SELLER.  We have no control over the quality, safety, or legality of items advertised the truth or accuracy of the listings, the ability of sellers to actually sell items they list, or the ability of buyers to actually buy items they bid on or request to purchase. 

    Because we are not involved in the transactions between the user and other users, the user hereby releases Classified CirclesTM, the volunteers, charity, foundation and our affiliates, agents, and employees from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with listings, bids, uncompleted or completed transactions, or items offered or actually sold.
     

  2. Acceptable Content

    Classified CirclesTM services may be used only for lawful purposes. Transmission, distribution or storage of material or conduct in violation of any applicable local, state, federal or foreign law or regulation is prohibited. This includes without limitation any unauthorized use of material protected by patent, copyright, trademark or other intellectual property right, material that is obscene, defamatory or libelous, constitutes an illegal threat, or violates rights of privacy or publicity, or violates export control laws.

    Classified CirclesTM prohibits the transmission, distribution or posting of unwanted or offensive content. Prohibited transmissions include without limitation, profane or sexually explicit advertisements that include masking or misspelling the words, or images that would be illegal in any jurisdiction. It is the user responsibility, and the user agrees to comply with all requirements, legal or other. Additional prohibitions include misleading offers that do not list the total purchase price or a "bait & switch" of products, advertisements listed in the incorrect category, duplicate listings, regardless of category, registering another email address other than the user’s own, any posting with the goal of harassment of another, harassment, placing a fraudulent ad or reply to an ad, or replying to ads with solicitations. Even though all of this is strictly prohibited, there is a small chance that the user might become exposed to such items and the user further waive the user’s right to any damages (from any party) related to such exposure.

    Classified CirclesTM reserves the right to edit, reject or reclassify advertisements in our sole discretion, without notice.

  3. Member Conduct

    The user understands that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that the user, and not Classified CirclesTM  and all volunteers who help with this effort, are entirely responsible for all Content that the user upload, post, email, transmit or otherwise make available via the Service. Classified Circles does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. The user understands that by using the Service, The user may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will your charity, Classified CirclesTM  and volunteers who help with this effort, be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

    The user agrees to not use the Service to:
     

·      upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

·         harm minors in any way;

·         forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

·         upload, post, email, transmit or otherwise make available any Content that The user does not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

·         upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;

·         upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

·         intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;

·         send solicitations in response to advertisements;

·         use advertisements or replies to commit fraud;

·        "stalk" or otherwise harass another; or  collect or store personal data about other users.

The user acknowledges that Classified CirclesTM does not pre-screen Content, but that Classified CirclesTM and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Service. Without limiting the foregoing, Classified CirclesTM and its designees shall have the right to remove any Content that violates the Terms of Service or is otherwise objectionable. The user agrees that the user must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, The user acknowledges that the user may not rely on any Content created by Classified CirclesTM or submitted to Classified CirclesTM, including without limitation information in all other parts of the Service.

The user acknowledges and agrees that Classified CirclesTM may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms of Service; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of Classified CirclesTM, its users and the public.

The user understands that the technical processing and transmission of the Service, including the user’s Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

  1. Dealings with Other Users

    The user correspondence or business dealings with readers and advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the user and such advertiser. The user agrees that your Classified Circles, charities and all volunteers who help with this effort shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

"The user Information" is defined as any information the user provides to us or other users in the registration, bidding or listing process, in any public message area (including the forums or the feedback area) or through any email feature. The user is solely responsible for the user’s Information, and we act as a passive conduit for the user online distribution and publication of The user’s Information.
 

      5.      Spam

 

Classified CirclesTM does not send or condone the use of Spam. As a registered user of our services, The user agrees that we may send email to the user that pertains to The user’s account or any of the services the user have signed up to use. There will be some emails, such as billing reminders, that are mandatory for the use of certain Classified CirclesTM services which the user are unable to opt out of.

Classified CirclesTM takes great precautions to protect The user’s email address. To prevent our users from receiving Spam or having their email address harvested by others, The user email address is not displayed to the public. In order to receive messages from other users, the user can choose between our secure message service or have Classified CirclesTM send the user entered message and email address to the user on their behalf.

Classified CirclesTM is not responsible for email sent to the user from others, including responses to classified ads or auctions, as part of the feedback process, from user information pages, and in the forums. If the user receives inappropriate email from a user through the Classified CirclesTM service, do not report Classified CirclesTM for Spam abuse or the user’s account may be terminated.
 

         6.          International Use

Recognizing the global nature of the Internet, The user agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, The user agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which the user resides.
 

7.         Warranty Disclaimer

THIS SITE, INCLUDING ANY CONTENT OR INFORMATION INCLUDED WITHIN IT OR ANY SITE-RELATED SERVICE, IS PROVIDED "AS-IS" WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON- INFRINGEMENT. THE USER ASSUMES TOTAL RESPONSIBILITY AND RISK FOR THE USER’S USE OF THIS SITE AND SITE-RELATED SERVICES.

Classified CirclesTM, THE CHARITY, VOLUNTEERS, ITS AFFILIATES AND ITS SPONSORS ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES ARISING OUT OF OR RELATING IN ANY WAY TO THE SITE, SITE-RELATED SERVICES AND/OR CONTENT OR INFORMATION CONTAINED WITHIN THE SITE. THE USER’S SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR SITE RELATED SERVICES IS TO STOP USING THE SITE AND/OR THOSE SERVICES.

ANY MATERIAL DOWNLOADED FROM THE SITE IS AT THE USER’S OWN RISK AND THE USER ARE SOLELY RESPONSIBLE FOR ANY DAMAGE DONE TO THE USER’S COMPUTER OR LOSS OF DATA THAT RESULTS FROM ANY DOWNLOAD.

 Classified CirclesTM MAKES NO WARRANTY THAT THE SITE AND/OR SERVICE WILL BE TIMELY, UNINTERRUPTED, OR ERROR-FREE, THE RESULTS WILL BE ACCURATE OR RELIABLE, THAT ANY ERRORS WILL BE CORRECTED, AND THAT THE SITE AND/OR SERVICE WILL MEET THE USER’S EXPECTATIONS AND/OR REQUIREMENTS.

Some states do not allow the disclaimer of implied warranties, so this disclaimer may not apply to the user.  Additionally this warranty gives the user specific legal rights, as well as other legal rights that vary from state to state.
